This Agreement outlines the terms, conditions, and responsibilities between Lensation Studio and the Client, ensuring clarity, transparency, and mutual understanding for the delivery of professional wedding photography services.

CLIENT AGREEMENT FOR PHOTOGRAPHY SERVICES
Melbourne, Victoria, Australia
This Agreement sets out the terms and conditions under which Lensation Studio provides wedding photography services. By booking, paying a booking amount, or engaging our services, you agree to the following clauses in full.
1. BUSINESS DETAILS & PARTIES TO THE AGREEMENT
This Agreement is entered into between:
Service Provider:
Lensation Studio - Based in Melbourne, Victoria, Australia.
Client(s):
The individual(s) named on the booking confirmation or invoice.
Together referred to as “the Parties”.
Acknowledgment
By signing this Agreement, the Client acknowledges that they have read and understood the business details of Lensation Studio and confirm they are entering into this contract with the correct legal parties.
2. DEFINITIONS & INTERPRETATION
For clarity throughout this Agreement:
“Photographer” refers to Lensation Studio and its representatives.
“Client” refers to the individual(s) booking services.
“Event Date” refers to the scheduled wedding date.
“Booking Amount” refers to the reservation fee.
“Services” refers to wedding photography services.
“Force Majeure” refers to events beyond reasonable control.
Headings are for convenience only and do not affect interpretation.
Acknowledgment
By signing this Agreement, the Client acknowledges that they understand the terms, definitions, and interpretation rules set out in this contract, and agree to abide by them.
3. SCOPE OF SERVICES
Lensation Studio agrees to provide professional wedding photography services as outlined in the selected package, booking confirmation, or invoice.
Services may include:
Wedding day photography coverage.
Candid, documentary, and posed imagery.
Professional editing consistent with Lensation Studio’s style.
Delivery of final edited images.
Services do not include videography, raw files, or unedited images unless explicitly agreed in writing.
Acknowledgment
By signing this Agreement, the Client acknowledges and agrees to the scope of photography services, including the agreed hours, locations, and deliverables described, and understands what is included and excluded.
4. BOOKING AMOUNT & PAYMENT BREAKDOWN
4.1 Booking Amount
To secure the Event Date, the Client is required to pay a booking amount equal to approximately ten percent (50%) of the total package price.
The booking amount:
Confirms the Client’s acceptance of this Agreement
Reserves the Event Date exclusively for the Client
Is deducted from the total package price.
Acts as a reservation fee and consideration for blocking the date.
No booking is considered confirmed, and no date is held, until the booking amount has been received and cleared.
4.2 Payment Breakdown
The total package price is divided into two components:
Booking Amount: Approximately ten percent (50%) of the total package price, payable at the time of booking.
Remaining Balance: The outstanding amount payable and must be fully paid and cleared before the Event Date, unless otherwise agreed in writing
A detailed breakdown of the total package price, booking amount, and remaining balance will be outlined in the Client’s invoice or booking confirmation.
4.3 Final Payment Terms
The remaining balance must be fully paid and cleared before the Event Date, unless otherwise agreed in writing.
Payment must be made using an accepted method (see Clause 4.4). Failure to ensure the balance is cleared prior to the wedding day may result in cancellation of services or postponement of image delivery, at the discretion of Lensation Studio.
4.4 GST Notice
All fees and charges payable under this Agreement are inclusive of Goods and Services Tax (GST) unless otherwise stated in writing.
Lensation Studio accepts GST-compliant payments only and will issue a valid tax invoice in accordance with Australian taxation requirements.
Accepted payment methods are:
Bank transfer, or
Cash
Card payments, including credit cards, debit cards, and digital wallet services, are not accepted.
The Client agrees to ensure that all payments are made using an accepted payment method and in accordance with the invoicing details provided by Lensation Studio.
Acknowledgment
By signing this Agreement, the Client acknowledges and agrees to the booking amount, payment breakdown, GST requirements, and the obligation to pay the full remaining balance before the Event Date.
5. REFUND POLICY
5.1 Cancellation by the Client
a. 90 days or more prior to the Event Date:
Full refund of the booking amount.
b. Less than 90 days prior:
Booking amount becomes non-refundable.
This reflects lost opportunity and preparation costs.
5.2 Cancellation by Lensation Studio
If cancellation occurs due to unforeseen circumstances or force majeure:
A full refund of the booking amount will be issued, OR
The Client may choose to reschedule at no additional cost.
5.3 Refund Processing
Refunds processed within 7-14 days.
Issued via original payment method.
Services already delivered are non-refundable.
Acknowledgment
By signing this Agreement, the Client acknowledges and accepts the refund policy, including the conditions under which refunds may or may not be issued.
6. RESCHEDULING CONDITIONS
6.1 Rescheduling by the Client
Clients must provide written notice at least 90 days prior to the Event Date if they wish to request a reschedule.
Rescheduling requests will only be accommodated if the requested new date is available.
Fee structure:
If the reschedule is requested more than 90 days before the Event Date, no rescheduling fee will apply.
If the reschedule is requested 90 days or less before the Event Date, a rescheduling fee of $500 will apply.
Important:
If the requested reschedule date is not available, the Client may propose an alternative date.
If the Client cannot agree on an offered alternate date/ original booking date, the request will be treated as a cancellation, and the cancellation policy (Clause 5) will apply.
6.2 Rescheduling by Lensation Studio
If rescheduling is required due to unforeseen circumstances:
We will offer a mutually agreed alternative date at no additional cost.
If the offered alternative date is not suitable to the Client, a full refund of all amounts paid will be processed.
Acknowledgment
By signing this Agreement, the Client acknowledges and agrees to the rescheduling conditions, including notice periods, reschedule fees, availability constraints, and the process for date changes or cancellations.
7. FORCE MAJEURE (NATURE CLAUSE)
Lensation Studio shall not be held liable for failure to perform due to events beyond reasonable control, including but not limited to:
Natural disasters
Severe weather
Fire, flood, pandemic
Government restrictions
Acts of God
Serious illness or injury
Unforeseen events that make it impossible or unsafe to conduct the Event
In such cases, rescheduling or refunds will be offered in good faith.
Notification Requirement
The affected party (either Lensation Studio or the Client) must notify the other party as soon as possible if a force majeure event occurs.
Rescheduling Options
Lensation Studio will make reasonable efforts to reschedule the Event to a mutually agreed date, subject to availability.
If rescheduling is not possible, the Client may:
Receive a full refund of amounts paid, or
Accept an alternative arrangement offered by Lensation Studio.
Limitations of Liability
Lensation Studio is not liable for any indirect, consequential, or additional costs incurred due to force majeure events, including but not limited to:
Travel or accommodation
Venue cancellation fees
Vendor rescheduling fees
Acknowledgment
By signing this Agreement, the Client acknowledges that they accept the risks of unforeseen events and agree to the process for notification, rescheduling, or refund as outlined above.
8. PHOTOGRAPHER ILLNESS OR EMERGENCY
This clause addresses situations where Lensation Studio or the assigned photographer is unable to attend the Event due to unforeseen circumstances.
If the photographer is unable to attend due to serious illness or emergency:
Reasonable efforts will be made to find a replacement.
If no replacement is available, liability is limited to refunding amounts paid.
No further compensation will be payable.
Definition of Emergency or Illness
Illness includes physical or mental health conditions preventing the photographer from performing their duties.
Emergencies include unforeseen events such as accidents, family emergencies, or natural disasters that make it impossible to attend the Event.
Notification to the Client
Lensation Studio will notify the Client as soon as possible if the photographer cannot attend due to illness or emergency.
Notification will be made via phone, email, or other agreed communication channels.
Alternative Arrangements
Lensation Studio will make reasonable efforts to provide a replacement professional photographer of similar skill and style, subject to availability.
If a replacement is not available or acceptable to the Client, the Event may be rescheduled, or other arrangements will be discussed.
Refund or Rescheduling
If the Event cannot be covered due to photographer illness or emergency and no replacement is available, the Client may:
Receive a full refund of amounts paid, or
Agree to a mutually acceptable rescheduled date at no additional cost.
Limitations of Liability
Lensation Studio is not liable for additional costs incurred due to rescheduling, including but not limited to travel, venue, or vendor fees.
The maximum liability is limited to the fees paid for photography services for the Event.
Acknowledgment
By signing this Agreement, the Client acknowledges that they understand the risk of photographer illness or emergency and accept the above provisions for notification, rescheduling, or refund.
9. CLIENT RESPONSIBILITIES
The Client acknowledges and agrees to the following responsibilities to ensure that Lensation Studio can deliver the highest quality photography services:
Providing Accurate Event Information
The Client must provide complete and accurate details regarding the Event, including:Wedding date, times, and venue addresses
Ceremony and reception schedules
Key participants for family or group photos
Obtaining Permissions
The Client is responsible for obtaining any required permissions or approvals from venues, religious institutions, or third-party locations for photography.Ensuring Guest and Participant Cooperation
The Client must ensure that key participants, family members, and guests cooperate during the photography process.
This includes attending scheduled photo sessions, responding promptly to instructions, and following directions for posed or group photos.Appointing a Point of Contact
The Client should assign a family member, wedding coordinator, or responsible adult to act as the main point of contact during the Event.Timely Notification of Schedule Changes
Any changes to the Event timeline, key participants, or locations must be communicated as early as possible.Ensuring Adequate Time for Photography
The Client is responsible for allocating sufficient time for group photos, couple portraits, and coverage at each location.Protection of Photography Equipment
The Client must ensure that Lensation Studio has reasonable access to safe and secure locations for photography equipment and is not exposed to unnecessary risks.Following Venue Rules and Local Regulations
The Client must ensure that photography complies with venue rules, legal requirements, and local regulations, including any permits or restrictions.Responsibility for Children and Pets
The Client is responsible for supervising children or pets during photography sessions to prevent interruptions or safety hazards.Providing Meals and Breaks for Extended Coverage
If coverage exceeds standard hours, the Client should provide meals, water, and breaks for the photographer(s).Limitation of Liability for Client Failures
Lensation Studio is not responsible for missed moments, incomplete shots, or reduced quality if the Client fails to meet any of these responsibilities.
10. EXCLUSIVITY & INTERFERENCE
To ensure that Lensation Studio can provide uninterrupted, professional, and high-quality photography services, the Client agrees to the following responsibilities and conditions:
Exclusive Photography Coverage
Lensation Studio shall be the primary photographer for the Event.Limitation on Other Photographers
The Client agrees that no other professional photographers, videographers, or media personnel will interfere with Lensation Studio’s work during the Event.Guest Photography Considerations
While guests may take casual photographs, the Client should ensure that they do not intentionally block or disrupt Lensation Studio’s professional coverage.Permission to Manage Photography Zones
Lensation Studio may direct where key group photos or portraits are taken, and the Client agrees to facilitate this process.Limitation of Liability for Interference
Lensation Studio is not responsible for missed moments, incomplete coverage, or compromised images caused by:Uncooperative guests
Other photographers or videographers
Venue restrictions
Event Interruptions
Any interruptions caused by the Client, family members, or guests that prevent Lensation Studio from completing coverage may result in limited or incomplete images, for which Lensation Studio is not liable.
11. CREATIVE STYLE & ARTISTIC DISCRETION
Clients acknowledge that:
They are familiar with Lensation Studio’s portfolio.
RAW files are not provided.
Photography is a blend of technical skill and artistic interpretation. To ensure clarity and manage expectations, the Client acknowledges and agrees to the following:
Artistic Vision of Lensation Studio
Lensation Studio operates with a distinct creative and photographic style, which may include:Documentary or candid storytelling
Artistic portraits
Use of natural light, composition, and editing techniques
Client Acceptance of Artistic Style
By agreeing to this contract, the Client acknowledges that they appreciate and accept the artistic vision, style, and approach of Lensation Studio, including the way moments are captured, edited, and delivered.No Guarantee of Specific Shots
While Lensation Studio will strive to capture requested moments, no guarantee is made that every specific shot, angle, or composition requested by the Client will be achieved.Image Editing and Post-Processing
All delivered images will be professionally edited according to Lensation Studio’s signature style.
Editing may include color correction, cropping, exposure adjustments, retouching, and other artistic enhancements.
Creative Discretion During Photography
The Client acknowledges that the photographer will exercise professional judgment in:Framing shots
Choosing vantage points
Capturing moments spontaneously
Adjusting lighting or positioning for optimal results
Client References and Inspiration
Clients may provide reference images or mood boards. Lensation Studio will consider these preferences, but the final images will remain consistent with the studio’s style.Limitation of Liability for Artistic Choices
Lensation Studio is not responsible for dissatisfaction arising from:Differences in artistic interpretation
Client expectations that are inconsistent with Lensation Studio’s style
Collaborative Communication Encouraged
Clients are encouraged to discuss key moments, must-have shots, and priorities prior to the Event.
12. IMAGE DELIVERY & STORAGE
Delivery timeframe: 4–8 weeks
Images delivered via online gallery or digital format
Long-term storage is not guaranteed beyond 6 months
To ensure clarity and transparency regarding how images are delivered and stored, the Client acknowledges and agrees to the following:

Lensation Studio will provide the final edited images within a specified timeframe, typically agreed upon in writing (e.g., 4–8 weeks after the Event).Delivery Format
Final images will be delivered in high-resolution digital format, typically via:Secure online gallery
Downloadable files
Number of Images
The Client acknowledges that the number of images delivered will reflect the coverage, event duration, and style of photography, rather than a specific quantity.Image Retouching & Editing
All images will be professionally edited according to Lensation Studio’s signature style (see Clause 11). Editing may include:Color correction
Cropping and composition adjustments
Retouching minor imperfections
Storage & Backup
Lensation Studio will store images on secure, professional-grade storage for a minimum period of 6 months from the Event Date.Responsibility for Downloading and Backup
The Client is responsible for downloading and backing up all digital images once delivered.Delivery of Physical Products
If a package includes printed albums, canvases, or other products, Lensation Studio will:Produce products using professional vendors
Deliver or ship products according to agreed timelines
Ensure quality control
Limitations on Liability
Lensation Studio is not liable for:Loss of images due to client failure to download or back up files
Damages to digital images after delivery
Delays caused by third-party services (e.g., mail, online platforms)
Client Permission for Online Galleries
Lensation Studio may provide password-protected online galleries for client convenience. Clients are responsible for sharing gallery links appropriately and ensuring privacy as needed.Client Satisfaction & Feedback
Clients are encouraged to provide timely feedback if edits or corrections are requested within a reasonable period after delivery (e.g., 14 days).Clients are responsible for backing up files.
13. COPYRIGHT & INTELLECTUAL PROPERTY
All images remain the intellectual property of Lensation Studio under the Copyright Act 1968 (Cth).
All photographs, images, and creative works produced by Lensation Studio are considered original works and are protected under Australian copyright law. The Client acknowledges and agrees to the following:
Ownership of Copyright
Lensation Studio retains full copyright and ownership of all photographs captured, edited, and delivered, including digital files, albums, prints, and online galleries.
Client License to Use Images
Upon full payment, the Client receives a non-exclusive, personal-use license to:
Print images for personal use
Share images on personal social media accounts or with family and friends
Use images for personal archiving and keepsakes
Prohibited Commercial Use
The Client may not sell, license, or use images for commercial purposes (e.g., advertising, promotion, or resale) without prior written consent from Lensation Studio.
Social Media and Online Sharing
The Client may post images on social media, but must credit Lensation Studio where possible.
Images may not be altered, edited, or used for promotional purposes without written permission.
Use by Lensation Studio
The Client grants Lensation Studio a perpetual, worldwide, royalty-free license to use images for:
Portfolio displays
Website, social media, marketing, and advertising purposes
Publications, exhibitions, or competitions
Copyright Protection and Enforcement
Unauthorized reproduction, distribution, or commercial use of Lensation Studio images is a breach of copyright law under the Copyright Act 1968 (Cth).
Lensation Studio reserves the right to take legal action in case of infringement.
Backup & Storage
While the studio stores images securely (see Clause 12), ownership and copyright remain with Lensation Studio.
Clients are responsible for backing up images for personal use, but this does not transfer copyright ownership.
Client Agreement to Artistic Use
By engaging Lensation Studio, the Client acknowledges and agrees that images may be used in marketing, social media, portfolios, and competitions as part of the studio’s creative promotion.
14. CLIENT USAGE LICENSE
Lensation Studio grants the Client a limited, non-exclusive licence to use the photographs delivered as part of their wedding package. This clause outlines the scope, limitations, and responsibilities of this licence:
Scope of Licence
Upon full payment of all amounts due, the Client is granted a non-transferable, non-exclusive, personal-use licence to:
Print photographs for personal use (albums, wall art, gifts, etc.)
Share images with family, friends, and personal social media accounts
Archive images for personal records and keepsakes
Prohibited Commercial Use
The Client cannot sell, license, or use the images for commercial purposes without prior written permission from Lensation Studio. Examples include:
Using images for business promotion
Selling images as stock or in publications
Using images in advertising, blogs, or media for profit
Modification and Alteration
The Client may not alter, manipulate, or edit the delivered images for public or commercial use without consent from Lensation Studio.
Minor personal edits for private use (e.g., cropping for personal albums) are acceptable.
Social Media Sharing
Clients may post images on personal social media accounts, but must:
Credit Lensation Studio wherever possible
Not remove watermarks (if applied)
Avoid using images in a misleading or commercial context without permission
Perpetual Use Rights for the Studio
By signing this contract, the Client acknowledges and consents to Lensation Studio retaining the right to use images for:
Marketing and promotional purposes (website, social media, advertisements)
Portfolio display and competitions
Exhibitions or press publications
License Termination
The usage licence granted to the Client may be revoked if images are used in a way that:
Breaches copyright
Violates this agreement
Misrepresents the work or the studio
Responsibility for Third-Party Use
Clients are responsible for ensuring that any third parties (friends, family, wedding vendors) who receive images comply with this usage licence.
Acknowledgment of Artistic Work
By accepting this licence, the Client agrees to appreciate and respect Lensation Studio’s artistic interpretation, including the way images are captured, edited, and delivered (see Clause 11).
15. SOCIAL MEDIA & MARKETING POLICY
Lensation Studio may use images for:
Website
Portfolio
Social media
Advertising
Clients may opt out by written request before the Event Date.
To maintain the integrity of Lensation Studio’s work and ensure proper use of images for marketing, the Client acknowledges and agrees to the following terms regarding social media and promotional use:
Studio’s Right to Promote Work
Lensation Studio retains the right to use images from the Event for:
Website and portfolio
Social media platforms, including but not limited to Instagram, Facebook, TikTok, Pinterest, LinkedIn, and YouTube
Marketing materials, advertisements, and press publications
Competitions, exhibitions, or professional showcases
Client Consent for Marketing Use
By signing this contract, the Client provides perpetual, worldwide, royalty-free consent for Lensation Studio to showcase Event images on all social media platforms and marketing channels.
If the Client objects to the use of specific images, they must submit the objection in writing. Lensation Studio will make reasonable efforts to accommodate such requests.
Client’s Personal Use on Social Media
The Client may share images on personal social media accounts under the following conditions:
Credit Lensation Studio whenever possible
Do not remove watermarks applied by the studio
Do not modify images in a way that misrepresents the studio’s work or style
Reason: Encourages respectful sharing while maintaining your professional branding.
Prohibited Uses on Social Media
The Client may not:
Post images for commercial promotion or sale without written permission
Use images to misrepresent the studio’s work
Upload altered images that could damage Lensation Studio’s reputation
Reason: Protects your artistic integrity and prevents misuse of your work online.
Privacy and Guest Considerations
Lensation Studio will respect the privacy of all guests and clients in marketing use.
Images containing children, sensitive information, or private moments may not be shared without express permission from the Client and/or relevant individuals.
Client Requests to Limit Marketing Use
If the Client requests that certain images not be shared publicly, this request must be submitted in writing prior to or shortly after the Event.
Lensation Studio will make reasonable efforts to comply but cannot guarantee the removal of images already used in published content.
Attribution and Credit
Lensation Studio requests that whenever images are shared publicly by the Client, the studio is credited appropriately (e.g., @LensationStudio or studio website).
Acknowledgment of Artistic Work
By signing this contract, the Client agrees that they appreciate Lensation Studio’s artistic style in all images shared or showcased, and that the studio has the right to determine how the work is presented online.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Liability is limited to the amount paid
No liability for indirect or consequential loss
This clause sets the boundaries of responsibility for Lensation Studio regarding the services, products, and images delivered. By signing this Agreement, the Client acknowledges and agrees to the following:
Scope of Liability
Lensation Studio will use professional care, skill, and expertise in providing photography services.
However, the studio is not liable for any indirect, consequential, or incidental damages, including but not limited to:
Missed moments due to client or guest interference
Technical issues (e.g., camera malfunction, memory card failure)
Delays caused by traffic, weather, or other unforeseen events
Maximum Liability
In the unlikely event of a breach of contract, negligence, or failure to deliver, the maximum liability of Lensation Studio is limited to the total amount paid by the Client for the photography services.
Equipment & Backup Limitations
While Lensation Studio maintains professional-grade equipment and backup systems, failure of equipment or accidental loss of images will not result in liability beyond reshooting where possible or refund of the fee (see maximum liability).
Limitation on Claims for Emotional or Subjective Dissatisfaction
Lensation Studio is not liable for subjective dissatisfaction with artistic style, composition, or editing choices, as these are part of the studio’s professional discretion.
Acknowledgment of Limitation
By signing this Agreement, the Client acknowledges that they have read, understood, and accept the limitations of liability outlined above.
17. AUSTRALIAN CONSUMER LAW COMPLIANCE
Nothing in this Agreement excludes rights under the Australian Consumer Law (ACL).
Statutory guarantees apply where required.
Lensation Studio operates in accordance with the Australian Consumer Law (ACL) 2010, ensuring fair trading and consumer rights are upheld.
Consumer Guarantees
All services provided by Lensation Studio are guaranteed to be delivered with due care and skill.
Services will be fit for the purpose specified by the Client and delivered in a reasonable time.
Client Rights
Clients are entitled to remedies under ACL if services:
Are not provided with due care and skill
Do not match the description or agreed scope
Are unfit for the specified purpose
Remedies may include re-shooting, re-editing, or a refund (limited as per Clause 16 – Limitation of Liability).
Limitations and Exclusions
Certain liabilities may be limited where permitted under ACL, including consequential losses.
Lensation Studio will comply with ACL requirements while maintaining reasonable limits of liability as agreed in this contract.
Transparency and Disclosure
All terms, pricing, packages, and policies are clearly disclosed prior to booking.
Any changes to services or deliverables will be communicated in writing.
Fair Trading Practices
Lensation Studio guarantees honesty, professional conduct, and adherence to ethical standards.
Any disputes arising under ACL will first be addressed directly between the Client and Lensation Studio.
Acknowledgment
By signing this Agreement, the Client confirms understanding of their rights under ACL and agrees that the studio will act in compliance with Australian Consumer Law while applying the limitations in this contract.
18. PRIVACY & CONFIDENTIALITY
Personal information is handled in accordance with Australian Privacy Principles and will not be shared without consent.
This clause outlines how Lensation Studio handles personal information and ensures confidentiality for clients.
Collection of Personal Information
Lensation Studio may collect personal information, including names, contact details, addresses, and payment information, for the purpose of providing photography services.
Use of Information
Personal information will only be used to:
Communicate about bookings and deliverables
Plan, schedule, and coordinate the Event
Deliver products, albums, and digital galleries
Promote the studio in accordance with social media and marketing policy (Clause 15)
Confidentiality of Client Information
Any sensitive information shared by the Client, including private moments, venue details, or personal circumstances, will be treated as strictly confidential unless consent is given for disclosure.
Third-Party Disclosure
Personal information will not be sold or shared with third parties except as required to:
Deliver services (e.g., printing labs or album providers)
Comply with legal obligations or regulations
Third parties involved in production will be bound to maintain confidentiality.
Data Storage & Security
Lensation Studio securely stores digital files and personal information in line with standard data protection practices.
Clients are responsible for personal backups of delivered images, but this does not affect confidentiality obligations.
Client Rights
Clients may request access to, correction, or deletion of personal information held by Lensation Studio, in accordance with Australian privacy laws.
Acknowledgment
By signing this Agreement, the Client acknowledges that their personal information will be handled securely, used appropriately, and kept confidential except where required by law or for agreed marketing purposes.
19. MODIFICATIONS & SEVERABILITY
Lensation Studio may update terms with notice.
If any clause is deemed unenforceable, remaining clauses remain valid.
This clause ensures that the contract remains enforceable even if certain parts need to be updated or are found invalid.
Modifications to the Agreement
Any changes, updates, or amendments to this Agreement must be made in writing and signed by both Lensation Studio and the Client.
Verbal agreements or informal changes are not legally binding.
Severability
If any provision of this Agreement is deemed invalid, illegal, or unenforceable under applicable law, that provision will be severed from the Agreement.
The remainder of the Agreement will continue in full force and effect.
Impact on the Agreement
Severing an invalid clause does not affect the validity or enforceability of the remaining clauses.
The intent of the parties is to uphold the terms of the contract as much as legally possible.
Acknowledgment
By signing this Agreement, the Client acknowledges that they understand that:
Changes must be written and signed.
Invalid clauses do not void the rest of the contract.
The Agreement will remain binding and enforceable.
20. GOVERNING LAW & ACCEPTANCE
This Agreement is governed by the laws of Victoria, Australia.
This clause clarifies the legal jurisdiction of the contract and confirms the Client’s agreement to the terms.
Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Victoria, Australia.
Any disputes arising from this Agreement will be subject to the courts and legal processes in Victoria.
Acceptance of Terms
By signing this Agreement, the Client acknowledges that they have:
Read and understood all clauses of the contract
Agreed to all terms, including payments, liability limitations, copyright, social media usage, and personalised storytelling
Accepted the studio’s artistic discretion, style, and delivery process
Binding Agreement
This Agreement constitutes a legally binding contract between Lensation Studio and the Client.
The Client’s signature or written acceptance confirms full consent to all terms outlined.
Dispute Resolution
Any disagreements or disputes will first be attempted to be resolved amicably between Lensation Studio and the Client.
If a resolution cannot be reached, disputes will be resolved according to Victorian laws and courts.
Acknowledgment
By signing, the Client confirms that they are legally competent to enter this Agreement, understand their rights, and consent to the terms without duress.
